Senior offshore engineering that passes a US security review.

US buyers are not short of offshore vendors. They are short of vendors whose work survives the security questionnaire, the state AI statutes now in force, and the board's question about whether the AI feature actually works.

01Who we work with
  • Product and SaaS companiesShipping AI features to customers who now ask for model documentation, training-data terms and evaluation results in the security review.
  • Agencies and consultanciesAdding a senior engineering bench for client work without carrying the headcount, and needing the IP and confidentiality chain to hold end to end.
  • Healthcare and health-tech teamsWhere an AI feature that touches PHI needs a Business Associate Agreement, minimum-necessary access and an inventory of the AI systems involved.
  • Founders past the prototypeWith a demo that works and a customer who wants it in production, with security, uptime and support to match.
02What is holding AI back here

What we see holding AI programmes back in this market, from the engagements we run and the regulation now in force.

  1. 01

IP and data security are the first questions asked of any offshore vendor

Intellectual property protection is the most-cited concern among US companies evaluating offshore development, with data security close behind. Layered protection is expected: full IP assignment, role-based access, audit logs and a documented breach process.

  2. 02

SOC 2 Type II and ISO 27001 controls are the baseline, not a differentiator

US procurement now treats these controls, along with MFA, least-privilege access and named breach-response commitments, as the minimum for an engineering partner.

  3. 03

State AI laws are in force, with no size threshold

Texas TRAIGA took effect on 1 January 2026 for any deployer whose AI reaches Texas residents, with penalties of $10,000 to $200,000 per violation and a safe harbour for organisations substantially following the NIST AI RMF. Colorado's replacement statute takes effect on 1 January 2027.

  4. 04

AI vendor questionnaires ask for documentation most vendors do not have

Buyers now ask about training-data provenance, output reliability, bias testing and AI-specific processing terms, and expect data processing agreements that prohibit training on their data without consent.

  5. 05

    HIPAA reaches into AI features

An AI feature that summarises charts or drafts patient communication is inside HIPAA's scope. BAAs, minimum-necessary controls and, under the 2025 Security Rule proposal, a written inventory of AI systems that touch ePHI become gating items.

  6. 06

Most AI pilots never reach production

Among organisations that suffered an AI-related security incident, 97 percent lacked proper AI access controls, and only a small minority ship agents with full security sign-off. The board wants evidence before approval, and pilots rarely produce it.

03The rules a build has to respect

What each obligation means for the system itself. We build the controls; your counsel confirms the legal position.

ObligationWhat it means for the buildTiming
Texas TRAIGAUnderstand the AI systems you deploy, document vendor relationships, keep human oversight over consequential decisions and maintain a compliance record. NIST AI RMF alignment is the practical safe harbour. In force since 1 January 2026
Colorado AI law (SB 26-189)Notice-based duties for consequential decisions made or assisted by AI.Effective 1 January 2027
HIPAABAAs with every party that touches PHI, minimum-necessary access, encryption in transit and at rest, and an inventory of AI systems handling ePHI.In force; Security Rule update proposed
CCPA and state privacy actsPersonal information in prompts, logs and training sets is regulated data. Retention, deletion and disclosure terms have to reach the AI layer. In force, expanding state by state
EU AI Act, for US companies selling into the EUHigh-risk obligations apply from 2 August 2026 regardless of where the company is headquartered.2 August 2026
04Included, where others charge extra or leave it out
  • Security review inside the build, not after it

Threat model, access control, secrets handling, dependency scanning and audit logging are designed with the architecture and documented as evidence your own auditor can read. Nothing is retrofitted for a questionnaire.

Access, secrets and logging designed so your SOC 2 auditor can trace them without a separate remediation project.

  • AI audit and evaluation you can hand to a regulator

Every AI feature ships with an evaluation set, grounding and hallucination measurements, regression runs per release and traced inputs and outputs. The result is an evidence pack, not a demo.

The evaluation results and bias testing the security questionnaire asks for, produced as part of delivery.

  • Compliance mapped to the build

We map the system to the obligations that apply to it, control by control, so legal and security teams review a document rather than reverse-engineer the code. We are engineers, not your counsel, and we say so.

TRAIGA and NIST AI RMF expectations mapped to the system's records, oversight points and documentation.

  • Data residency and model-provider exposure settled in architecture

Where data lives, which model providers see which fields, and what stays in-region are decisions made in the architecture phase with options costed, not discovered in procurement.

Which fields reach which model provider, under which data processing terms, decided before the first prompt is written.

  • Human oversight for consequential decisions

Approval steps, confidence thresholds and human review queues are built into workflows that touch money, eligibility, health or employment, with logs that show who approved what.

Approval and review steps for hiring, lending, health and eligibility decisions, logged for the compliance record.

  • Portability and cost control by design

Model-portable interfaces, cost budgets per feature and monitoring from day one, so a provider change or a price change is a configuration decision rather than a rebuild.

Provider-portable design so a model or pricing change is a configuration decision.

06How the engagement runs
  • IP and confidentiality that hold end to endFull IP assignment, NDAs, least-privilege access to your systems and audit logs of our access available on request. The same chain applies when we work under an agency's client contract.
  • Overlap you can plan aroundOur working day covers the US morning for stand-ups and reviews, with extended cover for launches and incidents arranged in advance.
  • Written communication by defaultWeekly demos, written updates and milestone-based delivery. Decisions are recorded so your team never depends on being awake at the right hour.
  • US-style engagement termsDiscovery sprint, fixed-scope build or dedicated team, invoiced in USD against a written scope, with an exit and hand-over plan agreed at the start.
07Questions we are asked

We build to SOC 2 Type II control expectations and can supply the technical evidence, access records and process documentation your auditor asks for. Ask us about our current certification status and we will answer plainly rather than imply one.
